Psychic Services Agreement
This Psychic Services Agreement (the "Agreement") is entered into on this day of (the "Effective Date") between Jacqueline Rose, a licensed and certified psychic practitioner, doing business as Emerald Psychic & Crystals, located at 709 North Ridgewood Pl, Los Angeles, California, hereinafter referred to as the "Psychic," and [Client's Legal Name], residing at [Client's Address], City of [Client's City], State of California, Zip Code [Client's ZIP Code], hereinafter referred to as the "Client."
1. Psychic Services: The Psychic agrees to provide psychic services to the Client, including but not limited to tarot card readings, crystal ball readings, aura readings, energy healing, dream interpretation, chakra balancing, spiritual counseling, and related metaphysical and spiritual guidance services (the "Services"). The Parties shall discuss and agree upon the specific type of Services to be provided for each session.
2. Session Duration: Each psychic session will typically last for 45 minutes. The Client understands that the Psychic may extend the session at their discretion, depending on the nature of the reading and the Client's needs, subject to the Client's agreement.
3. Location: Psychic sessions will be conducted at the Psychic's business location at 709 N Ridgewood Pl, Los Angeles, California, unless otherwise agreed upon between the Parties. Remote sessions via phone or video conference are also available if preferred by the Client.
4. Fees: The Client agrees to pay the Psychic the agreed-upon fee for each psychic session. Any additional costs, such as travel expenses for in-person sessions outside of Los Angeles, will be discussed and agreed upon in advance.
5. Payment Terms: Payment for each session is due in full at the beginning of the session. The Psychic accepts payment in cash, credit card, check, or other mutually agreed-upon payment methods. A receipt for each payment will be provided upon request.
6. Cancellation and Rescheduling: The Client understands that scheduled sessions require a minimum of 24 hours' notice for cancellation or rescheduling. Failure to provide the required notice may result in a forfeiture of the session fee. In the event of unforeseen circumstances or emergencies, both Parties will work together to reschedule the session at a mutually convenient time.
7. Confidentiality: The Psychic agrees to keep all information shared during the session confidential. This includes all personal information, details of the reading, and any other information obtained during the session. The Psychic will not disclose any information to third parties unless required by law.
8. Ethical Practice: The Psychic is committed to providing Services in an ethical and professional manner. The Psychic adheres to a strict code of ethics that includes honesty, integrity, respect for the Client's autonomy, and confidentiality. The Psychic will not engage in any unethical practices, including but not limited to making false promises, engaging in unethical financial practices, or providing medical or legal advice.
9. Professional Development: The Psychic agrees to continually develop their psychic and metaphysical skills through ongoing education and training to better serve the Client.
10. No Guarantees: The Client understands and acknowledges that the Psychic cannot guarantee specific outcomes or results from the Services provided. The information provided during the session is for guidance and entertainment purposes only. The Client is responsible for their own decisions and actions.
11. Disclaimer: The Client acknowledges that the Services provided by the Psychic are not a substitute for professional advice, such as medical, legal, financial, or psychological counseling. The Client agrees to consult with the appropriate professionals for such advice.
12. Liability Release: The Client understands and agrees that the Psychic shall not be held liable for any actions, decisions, or consequences resulting from the information provided during the session. The Client releases the Psychic from any and all liability.
13. Recording: The Client may request to record the session for personal use. However, the Psychic retains all rights to any audio or video recordings made during the session for their records and may not be distributed without the Psychic's written consent.
14. Session Notes: The Psychic may take session notes for their reference, which will be kept confidential. The Client may request to review these notes, but they will not be provided to the Client.
15. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of California.
16. Entire Agreement: This Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements, understandings, and representations, whether oral or written.
17. Amendment: This Agreement may only be amended in writing and signed by both Parties.
18. Termination: Either party may terminate this Agreement with written notice to the other party, provided that any ongoing sessions or commitments are fulfilled or reasonably compensated for.
19. Dispute Resolution: In the event of a dispute arising under or in connection with this Agreement, the Parties shall first attempt to resolve the dispute through good-faith negotiation. If negotiation fails to resolve the dispute within 10 (ten) days, either Party may initiate mediation.
- Mediation: Mediation will be conducted by a neutral third party agreed upon by both Parties. The cost of mediation shall be shared equally between the Parties.
- Arbitration: If mediation does not resolve the dispute within 10 (ten) days, either Party may proceed to binding arbitration in accordance with the rules and procedures of the American Arbitration Association. The decision of the arbitrator shall be final and binding on both Parties, and any judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
20. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
